Under the 2026 reform to the Industrial Property Law, IMPI now targets a 5-month resolution for clean, unopposed applications — down from the 8-12 months owners saw in prior years. If an opposition is filed, the process typically extends 12-18 months while IMPI resolves the dispute.
A registered trademark is valid for 10 years from the grant date and can be renewed indefinitely in further 10-year terms. There's a catch that trips up many foreign owners: trademarks granted on or after August 10, 2018 must file a Declaration of Use within three months of the third anniversary of registration — a non-extendable deadline with no grace period. Missing it results in automatic cancellation, no notice given.
